Rubbish Removal Wimbledon Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Wimbledon provides rubbish removal, waste collection and related services to customers. By making a booking, using our services or allowing our operatives to attend your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, organisation or other party requesting and paying for the services.

Services means any rubbish removal, waste collection, clearance, loading, transport, disposal, recycling, bulky waste collection, garden waste clearance or related services provided by us.

Waste means any items, materials, rubbish, refuse or goods that the Customer asks us to remove and which we agree to collect, subject to applicable waste regulations.

Premises means the property, building, land or location where we are instructed to collect Waste.

We, us and our mean Rubbish Removal Wimbledon, the service provider.

Contract means the legally binding agreement between the Customer and us for the provision of Services in accordance with these Terms and Conditions.

2. Scope of services

We provide rubbish removal and waste collection services, including but not limited to domestic and commercial clearances, garden waste removal, bulky item collection and general rubbish disposal. The exact scope of the Services will be agreed at the time of booking and confirmed in your booking confirmation.

We undertake to provide the Services with reasonable care and skill and in accordance with all applicable laws and regulations relating to waste handling and disposal in the United Kingdom.

We reserve the right to decline to provide Services in relation to any Waste that we reasonably consider unsafe, unlawful, hazardous, incorrectly described, or outside the agreed scope.

3. Booking process

Bookings may be made by telephone, email or through any other method we make available from time to time. When you contact us, we will usually ask for the following information:

1. Your full name and contact details.

2. The address of the Premises where the Waste is to be collected.

3. A description of the type and approximate volume or weight of Waste.

4. Details of any access issues, parking restrictions or special requirements.

5. Your preferred date and time window for the collection.

Based on the information provided, we may give an estimate or indicative quote. In some cases, we may need to attend the Premises or see photos to provide a more accurate quote.

A booking is only confirmed once we have accepted your request, agreed a date and time window, and provided confirmation verbally or in writing. We reserve the right to refuse any booking request at our discretion.

4. Estimates and pricing

Any price provided prior to our arrival is an estimate based on the information you give us. The final price may change if:

1. The actual quantity or type of Waste differs from what was described.

2. Access is more difficult than advised or requires significantly more labour.

3. Parking or loading is restricted or incurs additional charges.

4. Additional Services are requested on site that were not included in the original estimate.

Our charges may be based on volume, weight, time spent on site, type of Waste, disposal costs and any additional labour required. All prices will be stated before the work is carried out or continued, and you will be asked to confirm acceptance of any revised price before we proceed.

Unless otherwise stated, all prices are quoted in pounds sterling and are inclusive or exclusive of VAT as specified at the time of booking.

5. Access, loading and parking

The Customer is responsible for ensuring that we have suitable, safe and lawful access to the Premises during the agreed time window. This includes arranging any necessary permissions from building management, neighbours or local authorities.

You must inform us of any access restrictions, steps, narrow corridors, lack of lifts, height limits or other factors that may affect our ability to carry out the Services. Additional charges may apply where the conditions on site differ materially from those described at the time of booking.

The Customer must ensure that reasonable parking is available as close as possible to the Premises. Where parking charges, permits or fines apply, these may be added to the final invoice if not provided directly by the Customer.

6. Waste acceptance and exclusions

We collect most types of general household and commercial rubbish, including furniture, appliances, bagged waste, garden cuttings and similar items. All Waste must be capable of being safely handled by our operatives and transported in accordance with applicable laws.

Certain items are restricted or require prior agreement. We do not ordinarily accept:

1. Asbestos, clinical waste, medical waste or sharps.

2. Hazardous or toxic substances, including certain chemicals, oils, paints and solvents.

3. Gas bottles, fuel, explosives or pressurised containers.

4. Large quantities of soil, rubble or construction waste unless agreed in advance.

5. Any item that we consider to pose a health and safety risk to our staff or the public.

If prohibited items are discovered during loading, we may decline to remove them and may charge a call-out fee or additional handling charges. It is the Customer’s responsibility to disclose any such items in advance.

7. Customer responsibilities

The Customer warrants that:

1. They are the owner of the Waste or have full authority from the owner to arrange for its removal and disposal.

2. The Waste does not contain any items of value that the Customer wishes to retain.

3. The Waste is not hazardous, prohibited or misdescribed.

4. The Premises are safe and suitable for our operatives to work in.

5. They will provide accurate and complete information when making a booking.

The Customer is responsible for ensuring that any items not intended for removal are clearly separated or identified, and that pets, children and vulnerable persons are kept safely away from the work area while our operatives are on site.

8. Payments and invoicing

Payment terms will be confirmed at the time of booking. Unless we agree otherwise in writing, payment is due on completion of the Services on the day of collection.

We may accept various payment methods, which can include cash, debit card, credit card or bank transfer. We reserve the right to decline certain payment methods in specific circumstances.

For business customers, we may agree to issue invoices with specified payment terms. If so, payment must be made in full by the due date shown on the invoice. We reserve the right to charge interest on overdue amounts at the statutory rate applicable to late commercial payments and to recover reasonable costs of debt collection.

Ownership of any Waste passes to us only when payment has been received in full. However, this does not affect our right or obligation to handle and dispose of the Waste in accordance with applicable waste regulations once it has been collected.

9. Cancellations and amendments

You may cancel or amend your booking by contacting us as soon as possible. We ask that you provide at least 24 hours notice prior to the scheduled collection time for any cancellation or significant change.

If you cancel with less than 24 hours notice, or fail to provide access at the agreed time, we reserve the right to charge a cancellation or missed appointment fee to cover our reasonable costs.

We will use reasonable endeavours to accommodate any request to reschedule a booking; however, rescheduling is subject to availability and cannot be guaranteed.

We may cancel or amend a booking if:

1. We are unable to access the Premises safely.

2. Weather or traffic conditions make it unsafe or impractical to proceed.

3. We suspect unlawful activity or a breach of these Terms and Conditions.

4. Circumstances beyond our reasonable control prevent us from attending.

If we cancel a booking, we will aim to offer an alternative time or provide a refund of any amounts paid in advance for Services not yet provided, but we will not be liable for any indirect or consequential losses arising from such cancellation.

10. Performance and timing

We will use reasonable efforts to attend the Premises within the agreed time window. However, all times given for arrival or completion are estimates only and may be affected by traffic, weather, operational constraints or unforeseen events.

Time is not of the essence in relation to our performance, and we shall not be liable for delays that are outside our reasonable control. If we expect a substantial delay, we will use reasonable efforts to notify you and agree an alternative arrangement where possible.

11. Liability and limitations

We will take reasonable care while on your Premises and while handling your Waste. However, the Customer accepts that minor marks or scuffs may occur where large items are moved through tight spaces or where the Premises are already in a poor condition.

We shall not be liable for:

1. Any loss, damage or expense arising from inaccurate information provided by the Customer.

2. Any items removed as Waste which the Customer intended to keep but did not clearly separate or identify.

3. Any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity or loss of enjoyment.

4. Any delay or failure to perform caused by events beyond our reasonable control.

Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it is unlawful to exclude or restrict liability under UK law.

Subject to the above, our total liability to the Customer arising out of or in connection with any Contract, whether in contract, tort, negligence or otherwise, shall be limited to the total price paid or payable by the Customer for the relevant Services.

12. Compliance with waste regulations

We operate in accordance with applicable UK waste management legislation and regulations. This includes, where required, holding appropriate registrations or licences as a waste carrier and ensuring that Waste is transported and disposed of at authorised facilities.

We will take reasonable steps to maximise recycling and recovery of materials where practical. However, we do not guarantee that any specific proportion of the Waste will be recycled or that any particular disposal method will be used.

Upon collection, Waste becomes our responsibility and will be handled in compliance with relevant regulations. The Customer undertakes not to request or require us to breach any waste management or environmental laws and confirms that all Waste provided is lawful to transport and dispose of.

13. Complaints and disputes

If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing details of the issue and any supporting information. We will investigate the matter and aim to respond promptly with our findings and any proposed resolution.

We may ask for photographs or other evidence where appropriate. Any complaint relating to physical damage to property must be reported within a reasonable period from completion of the Services and before any repair or alteration is carried out, to give us a fair opportunity to inspect.

14. Data protection and privacy

We may collect and process personal data such as your name, address, contact details and payment information in order to manage bookings, provide Services, issue invoices and maintain records.

We will handle personal data in accordance with applicable UK data protection laws and only retain it for as long as reasonably necessary for the purposes for which it was collected, or as required by law. We will not sell your personal data to third parties.

15. Variations to these terms

We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our business practices or the Services we offer. The version in force at the time you make a booking will apply to that Contract.

Any changes will typically be published on our service literature or otherwise made available on request. Continued use of our Services after changes have been communicated shall constitute acceptance of the updated Terms and Conditions.

16. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision shall be deemed severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

17. No waiver

Failure or delay by us in exercising any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy, and any single or partial exercise of a right or remedy does not prevent any further exercise of that or any other right or remedy.

18. Governing law and jurisdiction

These Terms and Conditions, and any Contract between the Customer and us, are governed by and shall be construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation, including non-contractual disputes or claims.

By placing a booking with Rubbish Removal Wimbledon or by allowing our operatives to commence work, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
